KABUL (SW): The President Mohammad Ashraf Ghani has asked the Supreme Court to deliberate in the light of the Article 92 of the Constitution upon Wolesi Jirga’s move to unseat ministers.
Ghani’s deputy Mohammad Sarwar Danish, in a message, questioned the WJ’s move to unseat the ministers for not spending up to 70 of their annual development budgets. Danish has warned that the spate of no-confident votes against the ministers would cause a chaos in the country at this critical juncture.
According to the Article 92 of the Constitution, the Wolesi Jirga can only convene for the no-confidence vote against a minister when at least 20 percent of the members demand it. The Article notes: The House of People [Wolesi Jirga], on the proposal of 20 percent of all its members, shall make inquiries from each Minister. If the explanations given are not satisfactory, the House of People shall consider the issue of a no-confidence vote. The no-confidence vote on a Minister shall be explicit, direct, as well as based on convincing reasons. The vote shall be approved by the majority of all members of the House of People.
Danish acknowledged the WJ has the right to question and monitor the government but calling 17 ministers at a time for the no-confidence vote is questionable. Danish’s deputy Amanullah Fasehi, while reading out the VP’s message, said that the Supreme Court’s views have been sought in this regard.
