Sheikh Hibatullah Akhundzada, the leader of the Islamic Emirate, said in Article Five of a decree on women\u2019s rights issued in 2021 that a woman has the right to a fixed share (Ashab-ul-Furud) and a residual share (Al-Asabat) of the inheritance of her deceased husband, children, father and other relatives. No one can deprive her of this right.<\/strong><\/p>\n

Meanwhile, Saif-ul-Islam Khyber, spokesperson for the Ministry for the Promotion of Virtue and Prevention of Vice of the Islamic Emirate, says that tens of thousands of cases related to women\u2019s inheritance rights have been reviewed over the past five years, and more than 50,000 cases have been resolved.<\/p>\n

\u201cMany cases have been brought to the ministry in which women\u2019s inheritance rights had not been given to them by their brothers and other relatives for 10 to 20 years. Following the ministry\u2019s efforts, these women were given their inheritance rights. Raising public awareness is common within the ministry. Religious scholars also talk to people about this issue in mosques. The media also advises people. Officials (muhtasibs) are also told to teach people in some gatherings so that they can understand that women should receive their inheritance rights in the future,\u201d he adds.<\/p>\n

Legal experts and religious scholars also say that once a person becomes entitled to an inheritance, a woman\u2019s share is her religious and legal right, and no one can force her to give it up. They say a woman can make her own decision about her share and relinquish it to other heirs with full awareness and genuine consent.<\/p>\n

However, if the decision is made because of pressure, threats, force or fear of losing family relationships, the matter of genuine consent arises, and a woman can seek her right through legal channels.<\/p>\n

Parwiz Khalili, a legal expert, says that once a woman becomes entitled to an inheritance, she owns her share and can decide what to do with it. However, when relinquishing it to other heirs, it is fundamentally important that she gives her consent freely, with full awareness of the matter and without pressure.<\/p>\n

\u201cIf a woman is threatened and it is proven that she was forced, she can reclaim her right. The most important thing about relinquishing her share is consent. If a woman gives it with consent, has a high level of understanding, is not pressured by anyone in the gathering, and does not fear losing her social credibility or the breakdown of her family, she can relinquish it to other heirs with her own consent,\u201d he says.<\/p>\n

However, in some families, women say they have been forced to relinquish their inheritance share because of fear of losing family ties with their father\u2019s family, protecting the family name, and pressure from relatives.<\/p>\n

A woman from Takhar, who says her brothers forced her to give up her inheritance share. She explains,<\/p>\n

\u201cMy father owned land and a house, and I had a share as well. My brothers insisted that I should relinquish my share to them. They told me that if I did not give up my share, I would no longer be allowed to visit my father\u2019s house and that my relationship with them would be cut off. Because I did not want to lose my family, I was forced to accept.\u201d<\/p>\n

Another woman from Parwan also says, \u201cI was entitled to some land from my father\u2019s inheritance, and my brothers told me that if I took my share, people would talk about our family. The greatest pressure came from my brothers and the elders of my family. They told me that taking an inheritance share from my brothers was not right and would bring infamy to our family.\u201d<\/p>\n

Legal experts say that in such cases, it is important for women to be aware of the amount of their inheritance share, the documents related to the property, and the consequences of giving up their share.<\/p>\n

Before signing any document, a woman should know exactly what she is giving up and what religious consequences that decision may have for her.<\/p>\n

However, giving up an inheritance share does not always mean that a person was forced to do so. Some women say that after becoming aware of their rights and without being under any pressure, they decided to relinquish their share to one of their family members.<\/p>\n

A woman from Parwan says, \u201cNo one forced me to give up my share or took my property from me by force. It was their suggestion, but I made the final decision myself and gave it up with my own consent.\u201d<\/p>\n

Religious scholars also believe that inheritance is a woman\u2019s right and that taking this right from her through force or coercion is not permissible. They emphasize that if a woman is forced to give up her share, this is different from relinquishing it voluntarily or with her own consent.<\/p>\n

Abdul Ghaffar Ghaffarzada, a religious scholar, says, \u201cIt is absolutely forbidden (haram) to force someone to give up their inheritance share or put pressure on a woman to do so. In such cases, the property she is forced to give up is also absolutely forbidden for the person who takes it.\u201d<\/p>\n

Giving up an inheritance share can be a personal decision when a woman makes the decision with awareness, full authority, and genuine consent. However, fear of losing family ties can affect her will.<\/p>\n

Legal experts emphasize that before signing any document related to inheritance, women should be aware of the amount of their share, the contents of the document, and its legal consequences.<\/p>\n
