KABUL (SW) – A number of legal experts believe the extension of tenure for the National Unity Government is against the spirit of the Constitution.
In conversation with Salam Watandar, Waheed Farzaey, a legal expert, said the extension of president’s tenure beyond 21 May is illegal and in violation of the Constitution.
In the meantime, Abdul Ghafoor Ghayur, member of the Afghanistan Lawyers Association, has said this ruling by the Supreme Court to approve extension of the NUG tenure is a ‘political’ decision.
Meanwhile, Kabir Ranjbar, an expert on legal affairs, has maintained that the Supreme Court has the authority to ensure there is no vacuum of power after May 21. He said the apex court has issued a ruling in line with the Constitution that states the president would remain in power until a new president has taken oath.
According to the Constitution, the tenure of president ends on May 21 in fifth year of the tenure, and new polls should be held a month or two ahead of it.
A number of political figures are calling for establishment of an interim government to replace the NUG.
