KABUL (SW): The Wolesi Jirga (lower house) on Wednesday rejected the Presidential Decree No. 157 on the retirement age of the security officials.
After an extensive debate on the pros and cons of the Decree, the house rejected it with a majority vote. Shayesta Baz Nasiri, member of the house’s commission on defense and territorial integrity, said on the occasion that the members have worked extensively on this law, brought amendments to it, but the President went ahead with a decree on it.
Those opposing this Decree, stressed the President cannot legally issue a decree on maters for which legislation has been done by the house.
Meanwhile, Ramazan Bashar Dost, another member of the house, stressed that the President is entitled to issue decrees while the house is on recess, hence the rejection of the Decree is violation of the Article 97 of the Constitution.
Previously, the personnel law broadly covered officials associated with the Ministry of Interior (MoI), Ministry of Defense (MoD), the National Directorate of Security (NDS) and other civilian bodies, but the President issued a new Decree establishing separate rules for the MoI, NDS and one for the MoD based on nine chapters and 91 articles for the MoD.
